Terms and Conditions for Giggles ERP

Welcome to Giggles ERP, a product of Techno Infonet Gujarat Pvt. Ltd. These terms and conditions (“Terms”) govern your access to and use of Giggles ERP, including desktop, web, and mobile platforms. By using Giggles ERP, you agree to these Terms.

Definitions

Giggles ERP: Refers to the software, including desktop applications, browser-based platforms, and mobile apps, developed and owned by Techno Infonet Gujarat Pvt. Ltd.

User: Refers to any individual or entity accessing or using Giggles ERP.

Customer: refers to businesses or individuals who purchase subscriptions or licenses to Giggles ERP.

License and Use

License Grant: Techno Infonet Gujarat Pvt. Ltd. grants you a non-exclusive, non-transferable, revocable license to use Giggles ERP solely for lawful business purposes..

Restrictions: Reverse engineer, decompile, or disassemble the software. Share or distribute the software or access credentials without written permission. Use the software for any unlawful or fraudulent purposes.

Ownership : All intellectual property rights, including source code, design, and functionalities of Giggles ERP, remain the exclusive property of Techno Infonet Gujarat Pvt. Ltd.

User Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Compliance with Laws: You agree to comply with all applicable laws, including but not limited to GST regulations, data privacy laws, and business standards in your jurisdiction.

Data Accuracy: You are responsible for ensuring the accuracy of the data entered into Giggles ERP.

Backup: While we strive to ensure data safety, you are encouraged to maintain backups of critical business data.

Fees and Payments

Subscription Fees: You agree to pay subscription fees as per the plan chosen. Fees are non-refundable unless otherwise specified.

Taxes: All applicable taxes, including GST, will be borne by the user.

Late Payments: Failure to pay invoices or Against proforma Invoice on time may result in suspension or termination of access to Giggles ERP..

Data Handling and Privacy

Data Collection: We collect and process your data as described in our Privacy Policy.

Data Ownership: All business data entered into Giggles ERP remains your property. However, we retain the right to anonymize and aggregate data for research and improvement purposes.

Data Security: We implement industry-standard security measures to protect your data. However, we cannot guarantee absolute security against cyber threats.

Third-Party Integrations

Usage: Giggles ERP may integrate with third-party services to enhance functionality. By enabling such integrations, you agree to their terms of use and privacy policies.

Liability: Techno Infonet Gujarat Pvt. Ltd. is not liable for issues arising from the use of third-party integrations.

Support and Maintenance

Availability: We strive to ensure the availability of Giggles ERP. However, occasional downtime may occur due to maintenance or unforeseen technical issues.

Updates: Regular updates will be provided to improve functionality and security. You are required to install updates promptly.

Support Services: Support is available as per the chosen subscription plan or During Business Hours. Additional support may incur charges.

Limitation of Liability

No Warranty: Giggles ERP is provided "as is" without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

Indirect Damages: Techno Infonet Gujarat Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use Giggles ERP.

Maximum Liability: Our liability is limited to the amount paid by you for Giggles ERP in the preceding 12 months or till Active Your License or Account only.

Termination

Termination by User: You may terminate your subscription by providing written notice as per the cancellation terms.

Termination by Company: We may suspend or terminate your account / License of for violations of these Terms or failure to pay fees.

Post-Termination: Upon termination, access to Giggles ERP will be revoked, and we may retain your data as required by legal or contractual obligations.

Indemnification

You agree to indemnify and hold Techno Infonet Gujarat Pvt. Ltd. harmless from claims, losses, damages, liabilities, and expenses arising from your use of Giggles ERP or breach of these Terms.

Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of India.

Dispute Resolution: Disputes shall be resolved through arbitration in City of Ahmedabad, Gujarat State of India, under the Arbitration and Conciliation Act, 1996.

Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or in-app notifications.
